County Clerk Marsha Abell estimates approximately 150 mailed-in absentee ballots were not counted because of handling errors, either by voters or by a temporary Election Office employee who was terminated. Some were not counted because they lacked the necessary two sets of initials, one each from a Republican and Democratic election worker.

Lawyers who have been documenting voting day problems in Ohio say they'll challenge the results of the presidential election as soon as the vote is official. The lawyers say documented cases of long lines, a shortage of machines and a pattern of problems in predominantly black neighborhoods are enough evidence to bring such a challenge.

The secretary of state's election rules went through at least four different versions this year before the final set of rules was issued on Oct. 22, less than two weeks before Election Day. Similarly, the statewide election judge training manual produced by the secretary of state's office was not issued until a week before the election. By that time, a substantial portion of the state's 16,000 judges were already trained, and many Coloradans had already cast their ballots during early voting. ... and the list goes on.

Yonkers. State Senate recount shows that nearly every lever machine had a higher count for Democrat Stewart-Cousins than was recorded from the precinct count. A judge has impounded the machines. The county Board of Elections disclosed Friday that seals on 22 machines were damaged or missing.

Fort Payne. The committee formed to keep Fort Payne dry has petitioned a court to nullify the election in which residents voted to make the city wet. The petition by Dry Forces of Fort Payne contends City Clerk Jim McGee improperly moved a polling station without the required City Council approval 90 days before the election.The Dry Forces allege that this disenfranchised voters had to go to two polling places to take part in the referendum.

Auglaize County In a letter dated Oct. 21, Ken Nuss, former deputy director of the County Board of Elections, claimed that Joe McGinnis, a former employee of ES&S, the company that provides the voting system in Auglaize County, was on the main computer that is used to create the ballot and compile election results, which would go against election protocol. Nuss was suspended and then resigned.

Warren County. Citing concerns about potential terrorism, officials locked down the county administration building on election night and blocked anyone from observing the vote count as the nation awaited Ohio's returns. The Warren results were part of the last tallies that helped clinch President Bush's re-election. James Lee, spokesman with the Ohio Secretary of State's Office in Columbus, said Thursday he hasn't heard of any situations similar to Warren County's building restrictions.

In Palm Beach County, Turia Hayden, a spokeswoman for Election Protection, said some voters, particularly in African-American neighborhoods, had problems locating their correct polling place because some voting sites were relocated in the wake of the recent hurricanes. When they showed up to vote at the old location, they found no signs or other assistance to help them find the new polling place.

Gaston County. A recount of curbside ballots found that the county had collected 803 such ballots. But Gaston reported only 708 votes in the presidential election, and Don Wright said it was unlikely that 95 voters had skipped that race. The executive director of the state board, Gary Bartlett, ordered Wright not to recount the ballots, which would establish whether some votes were missed. Bartlett said Gaston has already reported official results, and the number of votes was too small to change the result of any contest.

Voters in Pompano Beach discovered at the last minute their precinct had been moved from the Pompano Beach Civic Center to a nearby church. The discovery was made after an unknown number of voters had cast provisional ballots at the Civic Center. Precinct 1C has 1,200 registered voters. A similar problem was discovered Tuesday morning at Precinct 72Q in Weston, which has 1,920 voters. These provisional ballots will not count.

State J. Kenneth Blackwell said voters could not cast provisional ballots despite not receiving their absentee ballots in time. A judge overruled him, calling his statement a "failure to do his duty" and saying that the federal Help America Vote Act requires that people who claim to be eligible voters must be allowed to cast provisionals regardless of the reason they are not on the rolls or are challenged.

County Commissioners confirmed that they were acting on the advice of their Emergency Services Director, Frank Young.
